Welcome to Listing Labs. The terms “we”, “us”, and “our” refer to Listing Labs. Listing Labs operates this website and provides digital audit services related to Amazon product listings (the “Services”). Listing Labs uses Shopify as its commerce platform to facilitate payments and service delivery.

These Terms of Service (“Terms”) govern your access to and use of our website and Services. Please read them carefully, as they contain important information about your legal rights, including disclaimers and limitations of liability.

By accessing, browsing, or purchasing our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you should not use the Services.

SECTION 1 – ELIGIBILITY AND ACCESS

By using the Services, you represent that you are at least the age of majority in your jurisdiction and that you are using the Services for business or professional purposes.

To purchase or use the Services, you may be required to provide information including your name, email address, billing details, and Amazon listing information. You represent that all information provided is accurate, current, and complete.

You are responsible for maintaining the confidentiality of any account credentials and for all activity conducted through your account.

SECTION 2 – NATURE OF SERVICES

Listing Labs provides digital diagnostic audits of Amazon product listings. These Services are:

  • Informational and analytical in nature

  • Delivered digitally

  • Based on observable listing content and common marketplace enforcement patterns

The Services do not constitute legal advice, regulatory approval, medical advice, or guarantees of compliance, performance, or outcomes.

We do not implement changes, manage listings, or provide copywriting, design, advertising, or legal services unless explicitly agreed in writing.

SECTION 3 – ORDERS AND SERVICE DELIVERY

When you place an order, you are requesting the delivery of a digital audit service. Orders are considered accepted once payment has been successfully processed.

Due to the nature of digital services:

  • Orders cannot be cancelled once work has begun

  • Delivery timelines (e.g., 72 hours) are estimates, not guarantees

If we are unable to deliver the Service, your sole remedy is a refund as outlined in our Refund Policy [LINK].

SECTION 4 – PRICING AND PAYMENT

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice.

You agree to provide valid and authorized payment information. By submitting payment, you authorize Listing Labs to charge the applicable fees.

All Services are sold as one-time digital services, unless otherwise specified.

SECTION 5 – REFUNDS

Due to the custom and digital nature of the Services, refunds are only issued if the audit is not delivered within the stated timeframe, unless otherwise required by law.

Refund requests must be submitted in writing to the contact email listed below.

SECTION 6 – INTELLECTUAL PROPERTY

All content, methodologies, frameworks, audit formats, text, visuals, and materials provided by Listing Labs are the intellectual property of Listing Labs or its licensors.

You are granted a limited, non-transferable license to use the delivered audit for your internal business purposes only. You may not reproduce, distribute, resell, or publicly share the audit or its contents without prior written consent.

SECTION 7 – THIRD-PARTY TOOLS AND PLATFORMS

Our Services may reference or rely on third-party platforms, including Amazon and Shopify. We do not control these platforms and are not responsible for their actions, policies, or enforcement decisions.

Your use of third-party tools is at your own risk and subject to their respective terms.

SECTION 8 – SHOPIFY RELATIONSHIP

Listing Labs uses Shopify to provide the technical infrastructure for payments and website hosting. However, all transactions are conducted directly between you and Listing Labs.

Shopify is not responsible for the Services, their accuracy, or any disputes arising from them. You release Shopify and its affiliates from any claims related to transactions with Listing Labs.

SECTION 9 – FEEDBACK AND TESTIMONIALS

If you provide feedback, testimonials, or comments, you grant Listing Labs a non-exclusive, royalty-free license to use such feedback for marketing or service improvement purposes, unless you explicitly request otherwise in writing.

We may edit feedback for clarity but will not misrepresent its substance.

SECTION 10 – PROHIBITED USES

You agree not to:

  • Misrepresent the Services as legal, regulatory, or medical advice

  • Resell or redistribute audits

  • Use the Services for unlawful purposes

  • Attempt to reverse-engineer or copy our methodologies

We reserve the right to refuse service or terminate access for violations of these Terms.

SECTION 11 – DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
LISTING LABS MAKES NO WARRANTIES REGARDING ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE.

Any reliance on the Services is at your own risk.

SECTION 12 – LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTING LABS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION, ARISING FROM THE USE OF THE SERVICES.

Our total liability shall not exceed the amount paid for the specific Service giving rise to the claim.

SECTION 13 – INDEMNIFICATION

You agree to indemnify and hold harmless Listing Labs from any claims arising from:

  • Your misuse of the Services

  • Your reliance on the audit beyond its intended scope

  • Your violation of applicable laws or third-party rights

These Terms are governed by the laws of the jurisdiction in which Listing Labs is registered, without regard to conflict-of-law principles.
